The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. . A comparison is made between two unlikely debates over intelligence. One debate took place in 1550 at Valladolid, Spain, between Bartolomé de las Casas and Juan Gines de Sepúlveda over the intelligence of the Amerindian. The other debate is contemporary, between John Searle and various representatives of the “strong” artificial intelligence community over the adequacy of the Turing test for intelligence. Although the contemporary debate has yet to die down, the Valladolid debate has been over for four hundred years. (...) The question asked here is whether the contemporary debate can profit from the previous one. The common bond providing the basis for contrast is the issue of the “other” which is present in both debates. From this contrast, the observation is made that the question of meaning is intimately tied to the question of intelligence. (shrink)

Almost all admit that there is beauty in the natural world. Many suspect that such beauty is more than an adornment of nature. Few in our contemporary world suggest that this beauty is an empirical principle of the natural world itself and instead relegate beauty to the eye and mind of the beholder. Guided by theological and scientific insight, the authors propose that such exclusion is no longer tenable, at least in the data of modern biology and in our view (...) of the natural world in general. More important, we believe an empirical aesthetics exists that can help guide experimental design and development of computational models in biology. Moreover, because theology and science can both contribute toward and equally profit from such an aesthetics, we propose that this empirical aesthetics provides the foundation for a living synergy between theology and science. A partir de un enfoque filosófico interpretativo, este texto tiene por objetivo estudiar los alcances y limitaciones del modelo de lectura crítica propuesto por el Ministerio de Educación Nacional de Colombia. Para abordar lo anterior, en primer lugar, se estudia cómo están diseñadas las pruebas de lectura crítica y qué significa interpretar un texto; en segundo lugar, se analiza la importancia de la lectura crítica para el fomento de la sabiduría práctica, y, en tercer lugar, se responde por qué es (...) importante concebir la lectura como experiencia formativa desde perspectivas creativas y plurales. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

The Lasallian District of Medellin, Colombia requested Corporación Universitaria Lasallista to analyze the formation process received by postulants to De La Salle Brothers in Istmina, Colombia, from 2002 to 2010. Academic, religious, pedagogical, apostolic and personal formation experiences received there were analyzed in this case study –from a qualitative approach– by means of semi-structured interviews and focus groups. Personal and apostolic formations stand out among the results due to the characteristics of Istmina as a proper place for sensibilization and subjugation (...) in proof of vocation. However, the reach of integral formation is questioned because academic formation presented meaningful deficiencies. In conclusion, even though formation experiences in vulnerable contexts are appreciated –and contextualization of learning is deemed meaningful–, participants agree in the necessity of developing strong competences to face educational and apostolic practices. In the intellectual scene of 19th century Colombia, Soledad Acosta de Samper stands out for pioneering the recognition of the significance of women for society. This purpose can be found in her work as a journalist as well as in her essays and literary works. Thus, the aim of the article is to analyze from the standpoint of social criticism how are configured the female characters in the works Dolores: cuadros de la vida de una mujer y Teresa la limeña: (...) páginas de la vida de una peruana. Based on the analysis of these novels, the article seeks to show how she gives voice to the main characters of her work, thus looking into the intimacy of female thinking. With the latter, she not only contributed to the strengthening of the ideals of virtue fostered during 19th century, but also of the necessity of intellectual education of women as a fundamental requirement for the training of ideal female citizens. We draw from upper echelons theory to investigate whether the presence of a chief sustainability officer (CSO) is associated with better corporate environmental performance in highly polluting industries. Such firms are under strong pressure to remediate environmental damage, to comply with regulations, and to even exceed environmental standards. CSOs in these firms are likely to be hired as legitimate agents to lead and successfully implement environmental strategy aimed at reducing pollution levels. Interestingly and contrary to our expectations, we found that (...) the presence of a CSO is associated with higher levels of pollution emissions. Nonetheless, we found that the CSO has a positive influence on a firm’s environmental performance if faced with strict environmental regulations. We argue that the enforcement of environmental regulations enhances monitoring and accountability of pollution emissions. The sample for this study comprised all the S&P 500 firms required by the Environmental Protection Agency to annually report their toxic emissions to the Toxic Release Inventory. Data were collected for a 6-year period from 2006 to 2011. We used a panel data regression and employed propensity score matching to correct for potential endogeneity problems. (shrink)

Rare neuromuscular diseases are a group of pathologies characterized by a progressive loss of muscular strength, atrophy, fatigue, and other muscle-related symptoms, which affect quality of life levels. The low prevalence, high geographical dispersion and disability of these individuals involve difficulties in accessing health and social care services. Teleassistance is presented as a useful tool to perform psychosocial interventions in these situations. The main aim of this research is to assess the effects of a teleassistance psychosocial program on the QoL (...) levels of people with RNMDs who have different levels of disability. A sample of 73 participants was divided into an experimental group, which participated in the intervention, and a control wait list group. QoL was evaluated through the SIP and the SF-36, and disability through the WHO-DAS II. The participants with a moderate to severe level of disability were those who most benefited from the intervention. The results also revealed that the psychosocial teleassistance program was suitable to improve physical and psychosocial aspects of people suffering from a rare neuromuscular disease with a moderate level of disability, but just psychosocial aspects in those with a severe level of disability. El filósofo propone como alternativa a la subjetividad neoliberal: la concepción del individuo como una desfuncionalizada obra de arte. Esta alternativa se completa con la recuperación de la principal propuesta del pensamiento cosmista: la transformación de la tecnología museística en biopolítica, para que el individuo de nuestro tiempo sea objeto de permanentes cuidados. In this article we identify three previously unnoticed problems with flexible moral theories, i.e., theories according to which different moral rules apply when there is full compliance and when there is partial compliance. The first problem is that flexible theories are necessarily very complex, which undermines their ability to motivate and guide action. The second problem is that flexible theories allow for a troubling kind of (moral) domination: the duties an agent has depend on other agents' willingness to comply. Finally, (...) flexible theories introduce indeterminacy: it is sometimes impossible to determine which moral rules apply. When agents stand at the threshold—i.e., when a different rule would apply if a single additional act of noncompliance took place—it is impossible to determine which rule should apply. (shrink)

The paper shows how relevant the relationship between theoria and the Holy Scriptures is in order to understand Alfonso de la Torre’s Visión Deleytable. The criticism of the Creation by the allegorical character “Entendimiento” agrees with the tradition of the unbelieving “Marrano” Averroism that culminates in XVIIth century Holland, since de la Torre comes across as a philosopher who dispenses with the knowledge revealed by the Scriptures. On the other hand, the objections by “Insight” concur with a philosophy that aims (...) to harmonize reason and Holy Writ, as in the case of Maimonides. This harmonization turns out perfect in the Prophet because he is inspired by the active intellect. Due to the decisive influence of Muslim and Jewish prophetology on Alfonso de la Torre’s work, we state that this text is a very relevant example of philosophical Mudejarism. (shrink)

El artículo propone el concepto de paranoia política como una categoría muy útil para comprender algunas manifestaciones contemporáneas de las patologías del poder. Para ello se sirve de una perspectiva interdisciplinar, en concreto, del saber proporcionado por el psicoanálisis, la filosofía política, la teología y los estudios literarios o estéticos. El psicoanálisis elaborado por Freud y Lacan permite comprender por qué el sujeto paranoico es un sujeto megalómano e hiper-racional que pretende controlarlo todo. Se trata del sujeto soberano, no sólo (...) adecuado a la sociedad de control definida inicialmente por Deleuze, sino también a una concepción de la filosofía que aspira a la totalidad. Tras abordar la estrecha relación entre paranoia y teoría política conspirativa, el artículo explica por qué la paranoia política contemporánea es un caso de la más radical teología política: el gnosticismo político. Con este último término se hace referencia a una concepción de lo político que reduce al Otro a la condición de enemigo absoluto que ha de ser eliminado. Finalmente se establece una estrecha relación entre la cura de la paranoia política y la asunción de una ontología de la incompletitud. (shrink)

Firstly, this paper tackles the way in which – within the Christian context – the body qua body, as the sole locus of existence, only arises when the disparity between the mortal creature and the immortal God is highlighted, that is to say, when man is regarded as a sort of vestigium Dei instead of an imago Dei. Throughout early modernity, only theologians and philosophers who, like Servet or Da Costa, posit the mortality of the soul are capable of presenting (...) the body in all its radicality. Contrarily, the body cannot truly appear in an anthropology which, as in Suarez’s case, sticks to the model of likeness or the imago Dei up to its last consequences. In his juridical-political theory, which operates to a certain extent within the regio dissimilitudinis, an authentic body does appear – namely, the social or political one. However, he returns to the realm of likeness, and so the autonomous view of the body is obscured, when he insists on the need of indirectly submitting the political body’s mortal soul to the immortal soul of the Church’s corpus mysticum. Citizen science is growing quickly, given its potential to enhance knowledge coproduction by diverse participants, generating large and global data sets. However, uneven participation in CS is still an important concern. This work aims to understand participation dynamics in CS and how they are shaped by participation barriers and drivers. We do so by examining participation in CONECT-e, a CS project that uses a wiki-like platform to document traditional ecological knowledge. More precisely, we analyze quantitative data on participants’ profile and (...) activity patterns and qualitative data on barriers and drivers of participation. Our findings suggest that overcoming the education, age, and residence participation barriers is challenging even in cocreated CS projects. This is potentially due to issues of perceived self-illegitimacy and low access to information and communication technologies. Our results also point out that participants’ alliance with the project’s objectives and trust relationships with the project team are important drivers of participation in CS projects. Finally, we also highlight the need to think beyond participation as single actions and rather consider participation diversity in CS as functional diversity in ecosystems, with participants performing a diverse set of interconnected tasks or functions. However, we consider that authentic democracy is that which is rarer, to be found beyond government and power, (...) where the nobodies, those who do not need any titles in order to participate in the public sphere, question –as Rancière explains– the continuity between the natural or social order and the constitutional or political order. The area of smart power grids needs to constantly improve its efficiency and resilience, to provide high quality electrical power in a resilient grid, while managing faults and avoiding failures. Achieving this requires high component reliability, adequate maintenance, and a studied failure occurrence. Correct system operation involves those activities and novel methodologies to detect, classify, and isolate faults and failures and model and simulate processes with predictive algorithms and analytics. In this paper, we showcase the application of a complex-adaptive, self-organizing (...) modeling method, and Probabilistic Boolean Networks, as a way towards the understanding of the dynamics of smart grid devices, and to model and characterize their behavior. This work demonstrates that PBNs are equivalent to the standard Reinforcement Learning Cycle, in which the agent/model has an interaction with its environment and receives feedback from it in the form of a reward signal. Different reward structures were created to characterize preferred behavior. This information can be used to guide the PBN to avoid fault conditions and failures. (shrink)

Araquistáin permaneció fiel a una visión regeneracionista del problema de España, fue accidentalista, su socialismo tuvo una clara inspiración neokantiana y prefirió por lo general una filosofía de orientación escéptica o relativista. En el siguiente artículo nos centramos en la secularización y crítica de la Modernidad que encontramos en la obra de Leo Strauss. A pesar de que este filósofo nos habla de la cólera antiteológica de los modernos, termina admitiendo que las novedades del Neuzeit no son absolutas y que resulta necesario apreciar cierta continuidad con respecto a la tradición judeocristiana. Otra de las peculiaridades de la interpretación straussiana es que identifica modernidad con una sola de sus corrientes, el liberalismo. Most cognitive scientists nowadays tend to think that at least some of the mind’s capacities are the product of biological evolution, yet important conceptual problems remain for all scientists in order to be able to speak coherently of mental or cognitive systems as having evolved naturally. Two of these important problems concern the articulation of adequate, interesting, and empirically useful concepts of homology and variation as applied to cognitive systems. However, systems in cognitive science are usually understood as functional systems (...) of some sort. Thus, to be able to talk about functional systems being homologous requires having a solid, adequate, and empirically articulated concept of functional homology—and the same is true about functional variation. Here I construct an original concept of functional homology that, in my view, adequately systematizes a number of actual uses of the word “functional homology” in a variety of biological disciplines and in ethology. I also propose a number of criteria for the empirical application of the concept that are analogous to the criteria that are currently used in comparative biology, ethology, and molecular developmental genetics. Then I construct a concept of functional variation on the basis of this concept of homology. (shrink)

Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)
